Terms of Service

These Terms of Service ("Terms") govern your access to and use of Bikelia (the "Platform", "we", "us"), including our website, listings, auctions, tours, messaging, blog, and any related services. By creating an account, listing a vehicle, placing a bid, joining a tour, or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use Bikelia.

1. Who we are

Bikelia is an online marketplace and community platform for buying, selling, and riding bikes and cars in Pakistan. We provide the technology that lets sellers list vehicles and buyers discover, contact, bid on, and negotiate with them. Bikelia is not a dealer, broker, auctioneer, inspector-of-record, or party to any sale. We act solely as a facilitator connecting independent buyers and sellers.

2. Eligibility & your account

• You must be at least 18 years old and able to enter a binding contract under the Contract Act, 1872, to create an account or list a vehicle.
• You are responsible for the accuracy of the information you provide and for all activity under your account.
• You must not impersonate another person, create multiple accounts to evade suspension, or share your login credentials.
• We may suspend or terminate accounts that violate these Terms, list prohibited or misleading content, or are used fraudulently.

3. Listings — seller responsibilities

By publishing a listing (bike, car, or tour), you represent and confirm that:

• You own the vehicle or are authorised to sell/list it, and it is not stolen, encumbered, or subject to an undisclosed lien.
• All details (make, model, year, mileage, price, condition, photos, and documents) are accurate and not misleading to the best of your knowledge.
• Transfer of registration/ownership will be completed through the appropriate Excise & Taxation / Motor Registration Authority in accordance with applicable motor vehicle laws — Bikelia plays no part in this process.
• If you enable Auction pricing on a listing, you agree to sell to the highest qualifying bidder once the auction concludes, subject to good-faith verification of the buyer.

4. Buyers, bidding & auctions

• Placing a bid is a genuine offer to buy at that price; you should only bid on vehicles you intend to purchase.
• You are responsible for independently inspecting any vehicle, verifying its documents, and satisfying yourself of its condition and legal status before paying or transferring ownership — including vehicles carrying a Bikelia inspection report, which reflects a point-in-time visual assessment only and is not a guarantee.
• All negotiation, payment, and delivery arrangements happen directly between buyer and seller. Bikelia does not hold, process, or guarantee any payment made between users.

5. Disclaimer & limitation of liability

Bikelia is not responsible and cannot be held liable for any transaction, dispute, loss, or damage arising between buyers and sellers, including but not limited to: vehicle condition, title defects, misrepresentation, non-payment, non-delivery, fraud committed by another user, or the outcome of any bid or auction. Any information, valuation, or inspection report on the Platform is provided for general guidance only and does not substitute independent legal, financial, or mechanical due diligence.

To the maximum extent permitted by Pakistani law, Bikelia, its owners, and employees disclaim all warranties (express or implied) about the Platform's content or any listed vehicle, and shall not be liable for any indirect, incidental, or consequential loss arising from your use of the Platform or your dealings with another user. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

6. Tours & community features

Bike tours listed or organised through Bikelia are arranged by independent organisers (who may or may not be Bikelia staff). Riding always carries inherent risk. Participants join tours at their own risk and are responsible for their own safety gear, riding ability, and compliance with traffic law. Bikelia is not liable for injury, loss, or damage occurring during a tour.

7. Prohibited conduct

• Listing stolen, non-compliant, or illegally modified vehicles.
• Posting false, defamatory, obscene, or infringing content.
• Harassing other users, or attempting to defraud a buyer or seller.
• Scraping, reverse-engineering, or interfering with the Platform's normal operation.

8. Content & intellectual property

You retain ownership of the photos and text you upload but grant Bikelia a non-exclusive, royalty-free licence to host, display, and use that content on the Platform (and reasonable promotional excerpts of it) to operate the marketplace. You confirm you have the right to upload the content you post. The Bikelia name, logo, and site design remain our property.

9. Electronic contracting

By checking the acceptance box on signup or when listing a vehicle, you are entering into a binding electronic agreement. This is legally recognised in Pakistan under the Electronic Transactions Ordinance, 2002, which gives electronic records and acceptances the same legal effect as a signed physical document.

10. Changes to these Terms

We may update these Terms from time to time to reflect new features or legal requirements. Material changes will be highlighted on the Platform, and continued use after an update constitutes acceptance of the revised Terms.

11. Governing law & disputes

These Terms are governed by the laws of the Islamic Republic of Pakistan, including (without limitation) the Contract Act, 1872, the Sale of Goods Act, 1930, and the Prevention of Electronic Crimes Act, 2016. Any dispute concerning the Platform itself (as distinct from a dispute between a buyer and seller, which is between those parties) shall be subject to the exclusive jurisdiction of the courts of Lahore, Pakistan.
